Terms of Service & Rental Agreement

1. Overview

Welcome to Portable Climate LLC. By renting equipment or requesting services through portableclimate.com you agree to these Terms of Service. These terms describe rental policies, fees, responsibilities, and limits of liability.

3. Fees & Add-Ons

• Delivery & Setup: $49 (within 15 miles). Same-day rush +$35 (4-hour window).
• Pickup: Included.
• Damage Waiver (optional): 10% of the rental cost — covers accidental damage (excludes misuse or gross negligence).
• Security Deposit: $150 if customer declines the damage waiver.
• Accessories: window/slider kits, insulated ducts, condensate pump, heavy-gauge extension cords (available on request).
• Multi-room Discount: −10% on each additional unit delivered to the same address and time.

4. Payments & Deposits

Payment is due at booking. Security deposits (when applicable) are refunded after inspection on return, normally within 3–5 business days. We accept major credit/debit cards and the payment methods shown at checkout.

5. Cancellations & Refunds

• Cancellation > 24 hours before delivery: Full refund.
• Cancellation < 24 hours before delivery: 50% refund.
• No-show or same-day cancellation: No refund.

6. Customer Responsibilities

By renting, the customer agrees to:

• Provide a safe, accessible area for delivery, setup, and pickup (clear of hazards and obstructions).
• Ensure power requirements are met at the location (standard 120 V outlet or required electrical configuration for the rented unit).
• Operate the unit per instructions and not modify or disassemble equipment.
• Notify Portable Climate immediately of malfunctions or damage.

7. Equipment Condition & Damage

All equipment is tested and cleaned prior to delivery. If the damage waiver is declined, the customer is responsible for repair or replacement costs for loss or damage beyond normal wear. Portable Climate may retain part or all of the security deposit to cover damages, missing parts, or excessive soiling.

8. Liability & Limitations

Portable Climate is not liable for indirect, incidental, or consequential damages (including loss of business, relocation costs, or loss of use). Our total liability for any claim related to a rental is limited to the rental fees paid for the affected period.

9. Delivery & Pickup

Delivery windows are scheduled at booking. Someone 18+ must be present at delivery and pickup. Missed appointments may incur a rescheduling fee of $25.

10. Privacy & Data

We collect personal information necessary to fulfill rentals (name, phone, email, address) and may use analytics tools to improve our site. For full details, see our Privacy Policy.

11. Governing Law

These terms are governed by the laws of the State of Arizona. Any disputes will be resolved in the courts of Maricopa County, AZ.
